Getting divorced is sad, scary, and difficult. When you're at the point where you know you cannot be together anymore, deciding how to separate assets and co-parent is super emotional and can be highly contentious. It's unfortunate that so many couples have to fight this out in court. Some couples, however, are in a different place where they can collaborate and compromise and create a rational and fair plan. I don't litigate adversarial divorces, but I help create the space for soon-to-be-exes to explore how they can stay in partnership while navigating the "what ifs" and the "hows" of a post-divorce life. A will is a document that takes effect after you pass away and communicates your intentions with respect to who you want to take control of your possessions, who is in charge of delivery of those possessions, and, if you have minor children, who will raise and provide for them until they are adults. It's important to work with an attorney to craft a plan that will withstand scrutiny by courts and creditors after you're gone - when no one will be able to ask you to clarify or confirm what you wanted. The concept of creating a will is simple and straightforward enough, but people often avoid the task because it is scary to accept and process mortality. If you don't create your own plan, the government will create one for you and this is likely to cause a lot of strain for your family.
